Terms & Conditions of offer to earn Qantas Points for new investments in 12 Month Term Account of Credit Fund

About the Offer

  1. La Trobe Financial has partnered with Qantas to provide Eligible Investors with the opportunity to earn Qantas Points on any Eligible Investment into the 12 Month Term Account of the Credit Fund, subject to and in accordance with these Terms.
  2. These Terms govern the eligibility requirements for earning and being credited with Qantas Points. Eligible Investors accept these Terms each time they make an Eligible Investment into the 12 Month Term Account of the Credit Fund.

Who is eligible to earn points?

  1. An Eligible Investor is an individual who is resident in Australia and who is a QFF Member and who:
    • makes an Eligible Investment; or
    • is a Nominated Investor and the Nominating Account Holder makes an Eligible Investment.
  2. Eligible Investors must be a QFF Member to earn, be credited and redeem Qantas Points.
  3. Eligible Investors who are not a QFF Member must enrol in the QFF Program if they wish to earn Qantas Points on Eligible Investments, for which a joining fee administered by Qantas, may apply. Eligible Investors can apply to join the QFF Program, and apply to have all joining fees waived, by completing the La Trobe Financial – QFF membership free form.
  4. Membership, and the earning and redemption of Qantas Points, are subject to the QFF Program Terms and Conditions. Please refer to qantas.com/terms or call the Qantas Frequent Flyer Service Centre on 13 11 31 to obtain a copy.
  5. To be eligible to receive Qantas Points on an Eligible Investment, Eligible Investors:
    • must inform La Trobe Financial of their QFF Program membership number at the time of making an Eligible Investment; or
    • must:
      • at the time of making an Eligible Investment apply to join the QFF Program by completing the application form found at qantas.com/freejoinlatrobefinancial;
      • be determined by Qantas to be eligible for membership of the QFF Program within 7 days of making an Eligible Investment; and
      • inform La Trobe Financial of their QFF Program membership within 14 days of making an Eligible Investment.
  6. In the event that there are multiple Eligible Investors for a 12 Month Term Account, on the written instruction of one of the Eligible Investor(s) or Nominating Account Holder (as applicable), La Trobe Financial will apply Qantas Points earned on each Eligible Investment to:
    • all Eligible Investors equally or in such other proportions as instructed (at the discretion of La Trobe Financial acting reasonably);
    • a sub-set of the Eligible Investors equally or in such other proportions as instructed (at the discretion of La Trobe Financial acting reasonably); or
    • one Eligible Investor.
  7. An instruction given by the Eligible Investor(s) or Nominating Account Holder (as applicable) at paragraph 8 will apply for all future Eligible Investments and Qantas Points earned on those Eligible Investments, unless the Eligible Investor(s) or Nominating Account Holder (as applicable) notify La Trobe Financial in writing. Any change of instruction provided to La Trobe Financial in accordance with this paragraph 9 will apply to Qantas Points earned on future Eligible Investments at the direction of La Trobe Financial acting reasonably.

Who is NOT eligible to earn points?

  1. Despite anything else contained in these Terms, an Eligible Investor is NOT eligible to receive Qantas Points if:
    • they are referred to La Trobe Financial by a Financial Adviser, Authorised Representative, a Platform or other introducer for which commission is paid or La Trobe Financial’s management fee is rebated; or
    • the Eligible Investor or Nominating Account Holder are receiving other promotional benefits as part of their investment into the Credit Fund.

What is an Eligible Investment?

  1. An Eligible Investment is an investment of $10,000 or more by an Eligible Investor or the Nominating Account Holder (as applicable) into their 12 Month Term Account of the Credit Fund after the Commencement Date which La Trobe Financial, acting reasonably, determines to be a New Money Investment.
  2. A New Money Investment:
    • is an investment of new funds by an Eligible Investor or Nominating Account Holder (as applicable) into their 12 Month Term Account;
    • is a transfer of funds by an Eligible Investor or Nominating Account Holder (as applicable) from their Classic Notice Account or 90 Day Notice Account into their 12 Month Term Account;
    • is NOT a re-investment of funds redeemed from an Eligible Investor and / or Nominating Account Holder account; and
    • is NOT the transfer of funds held in, or redemption and re-investment from, an account of an Eligible Investor or a relative or associate of the Eligible Investor; and
    • is NOT the investment of funds on which an Eligible Investor or Nominating Account Holder (as applicable) has already earned Qantas Points.
  3. In the event La Trobe Financial forms the view that an Eligible Investor or Nominating Account Holder is attempting to unscrupulously or fraudulently take advantage of or abuse this offer, La Trobe Financial may:
    • report the Eligible Investor and / or Nominating Account Holder to Qantas;
    • at its sole discretion, determine that the Eligible Investor and / or Nominating Account Holder are no longer eligible to earn Qantas Points on any further investment into the Credit Fund; and
    • forfeit any Qantas Points which have accrued on an Eligible Investment.
  4. As outlined in the Product Disclosure Statement of the Credit Fund (a copy of which can be obtained from La Trobe Financial’s website):
    • an investment in the 12 Month Term Account is a 12 month investment;
    • withdrawals from the 12 Month Term Account prior to maturity is generally NOT permitted;
    • La Trobe Financial may consider a written request for early withdrawal from the 12 Month Term Account at its sole discretion, which is subject to the interests and needs of other investors; and
    • an early withdrawal from the 12 Month Term Account MAY BE SUBJECT TO AN EARLY WITHDRAWAL FEE.

How many Qantas Points can I earn?

  1. Except for promotional offers, Eligible Investments will accrue a designated number of Qantas Points (Earn Rate), as notified from time to time, for every dollar invested. Subject to these Terms, Qantas Points will only accrue on Eligible Investments which are received by La Trobe Financial as cleared funds. Accrued points have no monetary value, are not the property of the Eligible Investor, and are not transferable to any other person or entity or any other QFF Member, whether by operation of law or otherwise.
  2. As at the date of these Terms, Eligible Investors will earn on each Eligible Investment 250 Qantas Points for every $1,000 invested (or part thereof). An example of Qantas Points earned on Eligible Investments at the current Earn Rate are as follows:
  1. All fees and other costs associated with an investment in the Credit Fund are excluded from the calculation of Qantas Points earned.
  2. Only whole Qantas Points will be earned on an Eligible Investment, with Qantas Points earned rounded to the nearest whole Qantas Point.

PROMOTIONAL OFFER –DOUBLE QANTAS POINTS

Each Eligible Investment made by an Eligible Investor between 12.01am AEDST 1 March 2024 and 11.59pm AEDST 31 March 2024 (Promotional Period), will earn 500 Qantas Points for every $1,000 invested (or part thereof).

An example of Qantas Points earned on Eligible Investments at the Earn Rate during the Promotional Period are as follows:

This offer cannot be used with in conjunction with any other offer. Advised investors cannot benefit from this offer.

The standard Qantas Points (e.g. 2,500 Points on a $10,000 Eligible Investment) will be credited to the member’s Qantas Frequent Flyer account by the 7th of the subsequent month after the investment has been made. The additional Qantas Points (e.g. an additional 2,500 Points on a $10,000 Eligible Investment) earned on Eligible Investments through this Promotional Period will be credited to the member’s Qantas Frequent Flyer account in a separate transaction by 31 May 2024.

How are Qantas Points credited to a QFF Program account?

  1. Upon receipt of an Eligible Investment in cleared funds La Trobe Financial will calculate, at its sole discretion and acting reasonably, the Qantas Points earned on an Eligible Investment which are to be credited to the Eligible Investor’s account (Accrued Points).
  2. La Trobe Financial will provide Qantas with the Personal Information (including QFF Program membership number) of the Eligible Investor and the Accrued Points amount for the purposes of having the Accrued Points credited to Eligible Investor’s QFF Program account.
  3. Subject to these Terms, the QFF Program Terms and Conditions, and Qantas being able to verify the Personal Information of the Eligible Investor against the Qantas database of QFF Members, Accrued Points will be credited by Qantas to an Eligible Investor’s QFF Program account monthly, and generally within 60 days of an Eligible Investment being received in cleared funds by La Trobe Financial.
  4. La Trobe Financial will notify Eligible Investors (or the Nominated Account Holders) from time to time, through correspondence or account statements, of Accrued Points earned during the stated period. The crediting of those Accrued Points to the Eligible Investor’s account is strictly subject to these Terms, the QFF Program Terms and Conditions, and Qantas being able to verify the Personal Information of the Eligible Investor against the Qantas database of QFF Members.
  5. La Trobe Financial gives NO GUARANTEE that Accrued Points will be credited to an Eligible Investor’s account within 60 days after an Eligible Investment has been made or at all.
  6. Eligible Investors will NOT receive confirmation from La Trobe Financial that Qantas Points have been credited to their QFF Program account. Notice may be provided by Qantas through the usual QFF Member statements issued by Qantas from time to time.

How we will handle your Personal Information

  1. The privacy of each Eligible Investor is important to La Trobe Financial and all Personal Information will be kept securely and confidentially. All Personal Information provided by an Eligible Investor will be used by La Trobe Financial in accordance with its Privacy Policy.
  2. Eligible Investors acknowledge and agree that, subject to the Privacy Act 1988 (Cth), La Trobe Financial may use their Personal Information for promotional and direct marketing purposes, and may provide their Personal Information to Qantas, their agents, affiliates and related companies for the purposes outlined within these Terms.

General Terms and Conditions

  1. La Trobe Financial assumes no responsibility for Qantas Points credited to an Eligible Investor’s QFF Program account or the actions of Qantas in connection with the QFF Program or otherwise.
  2. La Trobe Financial assumes no responsibility for any loss or damage which is suffered (including but not limited to indirect or consequential loss) in connection with an Eligible Investor’s participation in this offer except for any liability which cannot be excluded by law.
  3. Qantas may suspend or terminate the QFF Program at any time it deems appropriate in accordance with the QFF Program Terms and Conditions. In such a case, La Trobe Financial will, as is reasonably practicable, provide prior written notice to Eligible Investors.
  4. La Trobe Financial and Qantas reserve the right to cancel, terminate, modify or suspend this offer and the Terms. Eligible Investors will be notified in accordance with applicable laws on or before the day the change takes effect either in writing or by electronic means. Eligible Investors may not be notified of changes which are immaterial. Where La Trobe Financial is not required to give Eligible Investors prior notice of any change, Eligible Investors may be notified of that change in their, or a Nominating Account Holder’s, next account statement.
  5. This offer cannot be used in conjunction with any other advertised or promotional offer.
  6. Eligible Investors are solely responsible for any government tax, duty or other charge imposed in respect of any Qantas Points earned.
  7. La Trobe Financial’s failure to enforce a particular term or condition of these Terms does not constitute a waiver of that term or condition by it.
  8. Investments in the Credit Fund (including Eligible Investments) are subject to the terms of the Product Disclosure Statement and the Credit Fund Constitution.
  9. Qantas Points are governed by and subject to the QFF Program Terms and Conditions.
  10. QFF Members are unable to use Qantas Points to pay for fees and charges in any way connected with their investment in the Credit Fund, and are not transferrable (other than in accordance with the QFF Program Terms and Conditions).
  11. An Eligible Investor’s rights under these Terms are personal to the Eligible Investor and may not be assigned or transferred without La Trobe Financial’s written consent.
  12. These Terms are governed by the law in the State of Victoria.
  13. In these Terms, capitalised terms have the following meanings:
    • Commencement Date means 1 August 2020.
    • Credit Fund means the La Trobe Australian Credit Fund ARSN 088 178 321.
    • Eligible Investor has the meaning as set out in paragraph 3 of these Terms.
    • Eligible Investment has the meaning set out in paragraph 11 of these Terms.
    • La Trobe Financial means La Trobe Financial Services Pty Limited ABN 30 006 479 527 and its related bodies corporate.
    • New Money Investment has the meaning as set out in paragraph 12 of these Terms.
    • Nominating Account Holder means the company, self-managed superannuation fund, trust or partnership who nominated the Eligible Investor as a Nominated Investor.
    • Nominated Investor means an individual who is nominated by a Nominating Account Holder to receive Qantas Points on Eligible Investments. A Nominated Investor can be:
      • company: a director, or directors, of a company investor;
      • self-managed superannuation fund: an individual trustee or individual trustees of a self-managed superannuation fund; or the director or directors of a corporate trustee;
      • trust: an individual trustee or individual trustees of a trust; or the director or directors of a corporate trustee; or
      • partnership: a partner or the partners of a partnership.
    • Qantas means Qantas Airways Limited ABN 16 009 661 901.
    • Qantas Points means points in the QFF Program.
    • QFF Member or QFF Members means a person or persons who are registered as a member or members of the QFF Program.
    • QFF Program means the loyalty program known as the Qantas Frequent Flyer program operated by Qantas or its related bodies corporate.
    • Personal Information has the meaning as that term is defined in the Privacy Act 1988 (Cth).
    • Terms means these Terms & Conditions and any replacement thereof.
  14. In these Terms, unless the contrary intention appears:
    • headings are for ease of reference only and do not affect the meaning of these Terms;
    • the singular includes the plural and vice versa;
    • other grammatical forms of defined words or expressions have corresponding meanings;
    • a reference to a paragraph is a reference to a paragraph of these Terms;
    • a reference to a statute, ordinance or by-law includes regulations and other instructions under it and consolidations, amendments, re-enactments or replacements of any of them;
    • ‘including’ means ‘including without limitation’;
    • a reference to dollars, “$”, “AUD” or currency means Australian dollars; and
    • a reference to ‘person’ includes an individual, company or legal person.
